Varley v Whipp (1900) 1QB 513 - - The plaintiff sold a reaping machine to the defendant as second hand. The machine was described to be about a year old because it was bought a new machine the previous year and was used to clear about 50 to 60 acres. When the defendant took delivery of the machine, it was discovered to be very old and he returned it to the plaintiff who brought an action against him to pay the price agreed to in the terms of the contract. - - The court held that the defendant could reject the goods since they did not fit the description provided and were a breach of condition as provided by section 13 of the Sales Of Goods Act 1893 which provides as follows; - - “Where there is a contract for the sale of goods by description, there is an implied condition that the goods shall correspond with the description; and if the sale be by sample, as well as by description, it is not sufficient that the bulk of the goods corresponds with the sample if the goods do not also correspond with the description.” - - #LSWK#Legal#CaseLaw#Law#CommercialLaw#SOGA#DivineAkporaye#Khara#Kharamoash#LawSessionWithKhara#Nigeria#TheWorld
