Joshua Minton was 2 years old when he was murdered by his day care provider, Vicki Chiles.
On the day Joshua passed away, Vicki had taped his mouth shut with masking tape because he wouldn't be quiet at nap time. She also taped his hands together.
When Joshua's mother dropped Joshua and one of his sisters off at Vicki's day care while she went to a doctor's appointment. Vicki reported that Joshua was being "especially whiney" during nap time. Because of this, she bound Joshua's hands with tape, and then put the tape over his mouth.
She left him alone in a room separate from everyone else. When Vicki finally returned to check on Joshua, he was unconscious. She removed the tape from his hands and his mouth, called 911, and then attempted to revive him with CPR.
When help arrived, Joshua showed no signs of life. DHS employees were notified about the situation and told Vicki that she needed to call the parents of the other children in her care and tell them that she was closing for the day. Vicki refused to do so at first, and then decided to. A few hours later, she was arrested.
Joshua was flown to another hospital where he passed away. The next day, DHS officially closed Vicki's day care. Vicki was also charged with first degree murder in Joshua's death. Joshua's autopsy report showed that he had suffocated. It also showed he had excess fluid in his brain and lungs because his mouth had been taped shut.
Vicki was found guilty of first degree murder. The jury recommended life in prison without the possibility of parole, but Vicki only ended up being sentenced to thirty years in prison.
About a year after Joshua's death, Vicki plead guilty to hitting an eight year old child in her care with a fly swatter multiple times. For this, she was sentenced to one year in the state prison.
