GO TO TRIAL OR SETTLE? If there is simply no way that your matter can settle, get ready to race to the finish line. In litigation, the party who is proactive, rather than reactive will often achieve the best results. Your claim shouldn’t just ramble along while you wring your hands hoping that the other side will come around.
If your matter is capable of settlement, it should be very well prepared going into any negotiation and you should be advised of the costs and potential outcomes at trial. The other party won’t be interested in the evidence you might get down the track, they’ll only care about what you actually do have. To exchange meaningful offers of settlement, thorough preparation is key.

Buying a fixer-upper? 🛠 It's wise to talk to your conveyancing solicitor before you sign the Contract. 📝 You may need to consider whether you'd like the Contract to be subject to a satisfactory building and pest report (or not). Claims for personal injuries by women can be assessed less favourably than claims by men. With some insurers applying a motherhood penalty it can be necessary to overcome assumptions that are simply not made about claims by men. This can result in claims being under valued or continuing longer to achieve a fair result. We assess every claim having regard to the life of each claimant and only recommend settlements which reflect a reasonable assessment of what a client would expect to achieve at trial.

OVERVIEW

Elizabeth Wilson QC was admitted to the Bar in 1996 and was appointed senior counsel in 2011.

Elizabeth has a broad criminal law and administrative and government law practice.

Elizabeth both prosecutes and defends criminal law and quasi criminal law matters. She also regularly represents prosecution authorities as well as corporate and individual defendants in large regulatory matters.

Elizabeth has extensive experience appearing in Inquests and Inquiries. In 2011, she was appointed as counsel assisting at the Queensland Floods Inquiry. Elizabeth appeared in the Royal Commission into the Home Insulation Programme and has been Queen’s Counsel for the State of Queensland in the Barrett Commission of Inquiry and the Juvenile Detention Review.

In 2015, Elizabeth was appointed by the State of Queensland to conduct an administrative review into the New Acland Mine Stage 3.

In addition to her private practice, Elizabeth is committed to assisting the legal profession by contributing to numerous professional bodies. Elizabeth is presently chair of the Bar Association’s Criminal Law Committee and is a member of both the Law Council of Australia’s Human Rights Committee and Criminal Law Committee. Amongst other roles on boards and committees, she also serves as a member of the Bond University Law Advisory Board and is a member of the Anglican Church Southern Queensland Professional Standards Committee.

Elizabeth is a regular advocacy coach at the Australian Bar Association’s intensive advocacy course.

Elizabeth has served as a sessional member of the Anti Discrimination Tribunal and QCAT.

Rebecca worked as a solicitor from 1991 to 1996 and was then called to the Bar. Appointed Queen’s Counsel in 2013, she has also been a member of the Bar Council of Queensland and sat on numerous subcommittees for the Bar Association of Queensland. In 2017 she was appointed Vice President of the Bar Association of Queensland. Between 2007 and 2010, and again in 2013, Rebecca held a position as a part-time member of the Queensland Law Reform Commission.
Rebecca has been named by Doyle’s Guide on numerous occasions – in 2016 as the only pre-eminent silk in Queensland in Estate Litigation, in 2017 as the only the Market Leader in Queensland in Estate Litigation, and in 2017 as one of only three silks in Australia as pre-eminent in that field of practice. She also continues to appear in Doyle’s guide for her practice in insurance litigation.
